Terms and Conditions
These Terms and Conditions ("Terms") govern your engagement with Cossette Productions Inc., doing business as Cossette Wallpaper® ("Cossette Productions," "we," "us," or "our") for the design, purchase, and installation of custom wallpaper and related services. You agree to these Terms when you sign or electronically approve a proposal that includes or links to them and expressly confirms your acceptance. Requesting a consultation alone does not create an obligation to purchase or pay for services. Any permission to use photographs or videos for public marketing is obtained separately.
These Terms, together with your approved proposal and any invoice, are the entire agreement between you and Cossette Productions. They replace all prior discussions, representations, and agreements, written or oral. If these Terms conflict with your approved proposal, the proposal controls.
1. Pricing and Scope
- Price is based on the wall dimensions measured at the estimation visit, as stated in your proposal.
- Price includes the estimation visit, wallpaper design, materials, and professional installation, unless the proposal states otherwise.
- Prices may change without notice before a proposal is issued. Proposals are valid for 30 days from the date issued.
- Wall repair, surface preparation, removal of existing wallpaper, and changes in dimensions or scope cost extra and require your written approval before work begins.
2. Orders and Accuracy
- A deposit of 50% of the project total is required before design begins. Except where cancellation or refund rights are required by law, custom orders cannot be canceled once the approved design has been sent for printing.
- If you cancel before printing begins, we may retain the reasonable value of design work already performed and documented, non-recoverable costs incurred specifically for your project, up to the amount paid. Any remaining amount will be refunded. Applicable design rates or cancellation charges will be disclosed in your proposal before approval.
- If we cancel or cannot complete your project for reasons within our control, we will refund payments attributable to products or services not provided. This provision does not limit any additional remedy available under applicable law.
3. Payment Terms
- A NON-REFUNDABLE DEPOSIT OF 50% of the project total is required to begin design.
- The balance is due in full before installation is scheduled. We will contact you within two business days after final payment is processed to schedule installation.
- Shipping charges, if any, are your responsibility.
- Credit cards: We accept Visa and Mastercard credit cards. Where permitted by law and applicable card-network rules, credit-card payments may carry a surcharge of up to 3%, not exceeding our applicable cost of acceptance or the card network’s permitted maximum. The surcharge will be disclosed before payment and itemized on your receipt. Debit and prepaid cards are not surcharged, regardless of how the transaction is processed.
- Checks: Allow up to 72 hours for processing. Returned checks incur the maximum service charge permitted under Fla. Stat. §68.065. Third-party checks are not accepted.
- Wire transfers: Third-party wire transfers are not accepted.
- Cash, check and Cash Apps payments are also accepted
4. Collections
Unpaid balances may be referred to for collection. You are responsible for reasonable collection costs and attorneys' fees, which must be paid in full before we resume work. Materials remain the property of Cossette Productions until full payment is received and processed.
5. Design and Approval
- Design begins once your proposal is approved and the 50% deposit is received and processed.
- Three rounds of design revisions are included. Additional revisions may incur design fees.
- Some design concepts are created or refined using AI image-generation tools. Changes to AI-generated concepts can require significant designer time to reach print-quality results and may incur additional designer fees, even within your included revision rounds. We will tell you the fee and get your approval before beginning any billable work.
- THE DESIGN IS FINAL ONCE YOU APPROVE IT AND IT IS SENT FOR PRINTING. NO CHANGES CAN BE MADE AFTER THAT POINT. Review all renderings carefully before giving written approval.
6. Customer-Provided Content
If you provide images, artwork, logos, or other content for your design, you confirm that you own it or have permission to use it. You agree to indemnify Cossette Productions against any claims arising from that content. We will not reuse your personal content in other projects without your written consent.
7. Intellectual Property
Cossette Productions retains all rights it holds in its designs, including designer-created elements, compositions, and modifications. You receive a limited, non-exclusive license to use the installed wallpaper in your space. We may use the design in our portfolio, marketing, and future projects unless an exclusive design agreement is signed. To request exclusive rights, ask in writing before design begins; additional fees may apply. Designs may incorporate AI-generated elements, which may not be eligible for copyright protection.
8. Colors and Materials
Colors may vary between screens, printed proofs, and installed materials because of lighting, wall texture, and display settings. Printed scale may also vary slightly from renderings. Our materials are not guaranteed against fading, shrinkage, or discoloration caused by washing, moisture, or contact with liquids.
9. Installation
- Before the installer arrives, clear the work area of all furniture, wall art, televisions, mounts, and decorative items. If the space is not ready, we may reschedule, and a $150 rescheduling fee applies.
- All painting and construction must be finished, with drywall and plaster sealed and paint-ready. Fresh paint must cure at least 7 days, or longer if the paint manufacturer requires.
- Our installer will inspect the wall surface before starting. If conditions are unsuitable, we will notify you and may reschedule at no additional charge. If you request installation on an unsuitable surface in writing, the warranty does not cover resulting defects.
- We are not responsible for pre-existing wall conditions or for damage caused by removing fixtures or mounts.
- If our installer is more than 30 minutes past the scheduled arrival time without contacting you, please call us.
10. 5-Year Limited Warranty
Cossette Productions provides a 5-Year Limited Warranty on materials and workmanship for installations performed by our team, starting on the installation date.
- Covers: Manufacturing defects in the wallpaper and installation errors by our team under normal use and normal indoor conditions (60°F–85°F, relative humidity up to 65%).
- Reporting: Please inspect the completed installation and report visible cosmetic installation defects within 7 calendar days after installation. Manufacturing defects and other covered workmanship defects, including seam lifting or peeling, may be reported throughout the five-year warranty period. Report a defect promptly after discovery and provide photographs and a description when reasonably available. These reporting requirements do not restrict rights that cannot be limited under applicable law.
- Does not cover: improper wall preparation by the customer; installation on unsuitable surfaces at your written request; moisture, humidity, or water beyond normal indoor conditions; bathrooms, kitchens, laundry rooms, or other high-moisture areas unless approved in writing; damage from cleaning methods other than those in Section 11; impact, pets, or misuse; modifications or repairs after installation; installations by others; structural movement or wall failure; and normal wear or fading from direct sunlight.
- Remedy: For a covered defect, we will repair the affected area or replace the affected panels at our expense, including necessary materials and installation labor. If repair or replacement is not reasonably practicable, we will refund the amount attributable to the defective portion of the project, including its installation. A credit toward a future project may be offered only with your agreement. Replacement panels may vary slightly in color from existing panels.
- This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state. Nothing in this warranty excludes rights or remedies that cannot be limited under applicable law.
- Manufacturing defects discovered during the five-year warranty period are covered when they occur under the approved conditions of use and are not caused by an applicable exclusion.
- To file a claim: Email info@cossettewallpaper.com or call (954) 701-1644 or (786) 814-6414 within the warranty period.
11. Care Instructions
Clean wallpaper only with a fragrance-free, alcohol-free, pH-neutral makeup remover cleansing towelette. Other cleaning products, abrasive materials, or liquids, may permanently damage the wallpaper. Damage resulting from improper cleaning is not covered by the warranty. Future removal of the wallpaper may affect the underlying wall surface, and we are not responsible for those effects.
12. SMS Communications
By providing your phone number and engaging our services, you consent to receive transactional text messages about your project, such as appointment confirmations, proposals, invoices, and updates. Reply STOP to opt out or HELP for help at any time. Message and data rates may apply.
13. Photography and Media Release
You allow Cossette Productions to photograph and video record the estimation, the installation, and the finished result, without compensation to you. We may use this media in our marketing, advertising, website, and social media, and may share it with Cossette Wallpaper® licensees and franchisees. We will not sell or license media to unaffiliated third parties without your separate written consent.
Media focuses on the wallpaper and the space. We will not publish identifiable people or your address without consent. 14. Personal Information
We share personal information with third parties only as needed to conduct business with you, in accordance with our Privacy Policy (cossettewallpaper.com/privacy-policy) and Cookie Policy (cossettewallpaper.com/cookie-policy).
We collect, use, retain, and disclose personal information as described in our Privacy Policy at cossettewallpaper.com/privacy-policy. This includes information used for consultations, design, production, installation, payments, customer support, and, where permitted, analytics and advertising.
Information about cookies, advertising technologies, and available privacy choices is provided in our Privacy Policy and cookie settings. Optional marketing consent is obtained separately where required.
15. Force Majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, hurricanes, flooding, supplier or supply-chain delays, government orders, labor disputes, or site access issues. We will notify you promptly and reschedule at the earliest practicable date, at no additional charge to you. All production and installation timelines are estimates.
16. Indemnification and Limitation of Liability
You agree to defend, indemnify, and hold harmless Cossette Productions and its employees, affiliates, suppliers, agents, contractors, and business partners from damages, losses, or expenses, including reasonable attorneys' fees, arising from your breach of these Terms.
To the fullest extent permitted by law, our total liability for any claim is limited to the amount you paid for the project giving rise to the claim. We are not liable for indirect or consequential damages. Nothing in this section limits our liability for gross negligence, willful misconduct, or fraud.
17. Governing Law and Disputes
These Terms are governed by Florida law, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts in Miami-Dade County, Florida, and you consent to personal jurisdiction there. The prevailing party in any dispute is entitled to reasonable attorneys' fees and costs.
18. Changes to These Terms
We may update these Terms at any time by posting a revised version with a new "Last Updated" date. We will give at least 14 days' notice of material changes. Your approved proposal is governed by the Terms in effect on the date the proposal was issued.
19. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
